Terms and Conditions
1. PURPOSE
The purpose of these general terms and conditions of sale is, on the one hand, to inform any potential consumer of the conditions and procedures under which the vendor sells and delivers ordered products, and on the other hand, to define the rights and obligations of the parties in connection with the sale of products by the vendor to the consumer. They apply, without restriction or reservation, to all sales by Sroka shop of products offered on its website.
Consequently, the act of any person ordering a product offered for sale on the Srokashop company website implies full and complete acceptance of these general terms and conditions of sale, which the Buyer acknowledges having read prior to placing their order.
Products are offered for sale in the following geographic territory: Europe and worldwide.
SROKASHOP reserves the right to modify these general terms and conditions of sale at any time.

3. PRICES
The selling prices of products online on the srokacompany.com website, indicated in Euros, are those in force at the time the order form is registered by the Buyer.
They include shipping costs, unless special conditions are indicated before purchase. In this case, shipping costs will be indicated before the order is registered by the Buyer and will be in addition to the order.
The selling prices of products may be modified by Srokashop at any time. The Buyer will be notified of this modification before any order.
4. PRODUCT CHARACTERISTICS
In accordance with article L 111-1 of the French Consumer Code, the Buyer may, prior to placing their order, consult on the srokacompany.com Website the essential characteristics of the product(s) they wish to order.
Offers presented on srokacompany.com are valid within the limits of available stock.
Photographs, graphics and descriptions of products offered for sale are for informational purposes only and do not bind the vendor.
Should a supplier modify a product, its graphical representation shall not incur the vendor's liability or affect the validity of the sale.
5. ORDER
Any order implies unreserved acceptance of these general terms and conditions of sale.

The Buyer's order must be confirmed by Srokashop, by e-mail.
The sale will only be considered final after Srokashop sends the Buyer an order confirmation and has received full payment.
Srokashop recommends that the Buyer keep this information on paper or in electronic format.
6. PAYMENT
Payment must be made by the Buyer at the time of ordering. At no time can the sums paid be considered as deposits or down payments.
The total amount of the order will be collected by Srokashop at the time of order validation or, in the case of payment by cheque, upon receipt thereof.
All orders are payable in Euros.
To pay for their order, the Buyer has all the payment methods mentioned on the order form: Online bank card (Carte bleue, Visa or Mastercard), bank cheque or bank transfer.
Srokashop reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and stage of execution, in the event of non-payment of any sum due by the Buyer or in the event of a payment incident.
Penalties equal to the legal interest rate increased by five points are automatically applicable to unpaid amounts after a period of ten days following the invoice date or notifications of bank payment rejection for any other payment method. The delivery of any new order may be suspended in the event of late payment for a previous order, notwithstanding the provisions herein.
Srokashop reserves the right to request a photocopy of the Buyer's identity card for any bank card payment.
In the context of the fight against internet fraud, information relating to your order may be transmitted to any third party for verification.
7. PRODUCT SELECTION
The Buyer, having familiarized themselves with the products and their characteristics marketed by Srokashop, has, under their sole responsibility and according to their needs as they had previously determined before any order, made their choice of the product(s) subject to their order. In addition, the Buyer, being the sole judge of the products they own and use, is the sole judge of the compatibility of the ordered products with those they use.
Srokashop provides the buyer with assistance in making their choice: – a help service by email, the addresses of which are indicated in the "contact us" section.
8. DELIVERY AND RECEIPT
8.1. GENERAL RULES
Products will be delivered to the address indicated by the Buyer on the order form, in metropolitan France and Corsica, or worldwide.
The Buyer can, upon express request, have the invoice sent to the billing address and not to the delivery address by validating the option provided for this purpose on the order form.
8.2. DELIVERY TIMES
It is important to distinguish between delivery times and shipping times.
The average lead times from the Srokashop warehouse are as follows: 48 hours in France and 3 to 5 days in Europe.
These deadlines are indicative.
Any exceeding of these deadlines shall not give rise to damages, withholding, or cancellation of the order by the Buyer.
In the event of a delivery delay compared to the initially set date, the Buyer must report it in writing (mail, email) to Srokashop in order to improve the quality of service that can be offered to them and to allow Srokashop to conduct an investigation with the carrier.
An investigation with the carrier can take up to 21 working days. If, during this period, the product is found, it will be immediately re-routed to the delivery location specified on the order form.
Should the ordered product no longer be available, the provisions of Article 8 will apply. In the event of product exchange, delivery costs will be borne by the consumer.
8.3. RECEIPT
Goods travel at the Buyer's risk. However, shipping costs include insurance against theft, damage and loss (the maximum amount of insurance reimbursement varies depending on the carriers).
Consequently, and in all cases, before accepting your delivery, please check the condition of your packages. In case of anomaly, refuse the package and indicate on the delivery note the reasons for refusal by listing the problems found, otherwise, no claim will be possible.
IMPORTANT!
Do not let the delivery person dictate your conduct or the elements to be written on the delivery note.
Limit yourself to indicating the damage observed, avoiding information that the delivery person may suggest, such as "packaging intact" or any other mention that could exclude their responsibility.
Finally, the reservation "subject to unpacking" is not valid and cannot be taken into account.
9. PRODUCT AVAILABILITY
In the event of partial availability of items, Srokashop may make a split delivery. In-stock products will be sent first. The remainder will either be delivered later, replaced by other equipment (with the Buyer's agreement), or refunded.
In all cases, Srokashop will inform the Buyer as soon as possible.
10. QUALITY OR COMPLIANCE ISSUES
In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the buyer must submit their complaint within 7 days from the signing of the delivery note.
Complaints must be sent by letter or email and must include: – the Buyer's contact details. – the product references. – the reasons for the complaint.
Products must be returned within seven working days from the attribution of a return number by Srokashop's customer service.
Failing this, Srokashop will not exchange or refund the products thus ordered.
Any product to be exchanged or refunded must be returned to Srokashop in its original condition and packaging and include the entire product and its accessories.
Any risk associated with the return of the product is borne by the Buyer.
Failure to comply with the procedure described above and the indicated deadlines, the Buyer will not be able to make any claim for non-compliance or apparent defect of the delivered products, the products then being deemed compliant and free from any apparent defect.
11. RIGHT OF WITHDRAWAL
• In accordance with the Consumer Code, the buyer has a period of 14 days, from the date of receipt, to return ordered products at their own expense for a refund.
The buyer must inform Srokashop, and the return can only be made after the latter's agreement and the allocation of a return number to be imperatively written on the packaging.
For hygiene reasons, the return of some of our products will not be accepted if the original packaging has been unsealed, opened, torn, or marked. All coverings are concerned.
• Products must imperatively be returned to Srokashop in perfect resale condition, in their original state (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the invoice corresponding to the purchase.
If the product includes a warranty sheet or any other document to be completed, it must not be filled in so that the buyer can exercise their right of withdrawal.
Any incomplete, damaged, or spoiled product, or a product whose original packaging has been deteriorated, will not be refunded or exchanged.
• The exercise of the right of withdrawal will result, at the buyer's choice: – either in a cash refund by re-crediting the bank card used during the initial order or, if impossible, by cheque. – or in the attribution of a purchase voucher valid on srokacompany.com. In both cases, after deduction of initial shipping costs, and return costs are at the customer's expense.
• In all cases, return shipping costs will be borne by the customer.
• In case of exchange with another product, new shipping costs will be due to Srokashop.
12. GENERAL REFUND CONDITIONS
In all cases, Srokashop will communicate by electronic message upon the allocation of this purchase voucher: – its validity period – whether or not the buyer will be able to request a refund and its amount
In the event of partial use of the purchase voucher, the remaining balance will remain available to the customer under the same conditions as the original credit within a period of one year.
A purchase voucher will be considered used even in the event of partial use or a refund request.
By using this purchase voucher, the consumer undertakes on their honor not to make any dispute or opposition to their bank or any other party regarding the transaction concerned by the refund, and undertakes not to do so within one year following the use of the purchase voucher.
The consumer acknowledges being aware that any breach of this obligation would expose them to the retrocession of the unduly received sum, without prejudice to any damages that Srokashop may claim from them.
13. WARRANTY
Some products sold benefit from a manufacturer's warranty, the general conditions of which vary from one supplier to another. The general conditions and duration of the warranty are available on the Srokashop website. The Buyer will be deemed to have consulted and accepted them.
Any return of the product under the aforementioned warranty must be subject to prior agreement from Srokashop. To this end, the Buyer will contact Srokashop's after-sales service.
No returns will be accepted without prior authorization from Srokashop.
If the product is recognized as defective, Srokashop will provide the buyer with a product return number. This return number, a determining and indispensable condition, is valid for seven working days, starting from the communication of the return number by Srokashop to the Buyer. After this period, the Buyer must renew their request, according to the procedure described above.
The defective product must be returned in its original packaging, include the entire product and its accessories, and be clearly accompanied by the product return number communicated by Srokashop and the product's serial number.
Any incomplete, damaged, or spoiled product, and/or any product whose original packaging has been damaged, will not be returned or exchanged under warranty.
All costs and risks associated with the return of the product are borne by the Buyer.
The product under warranty will be, at the manufacturer's discretion, exchanged or repaired.
Srokashop guarantees the Buyer, for hidden defects that may affect the delivered products, only by replacing defective products or parts that make them unfit for their intended use, without being held responsible by the Buyer for any harmful consequences that these hidden defects may have caused.
In any event, the warranties do not cover: – the replacement of consumables. – abnormal and non-compliant use of the products. – damage subject to a specific mention in the product sheets. – defects and their consequences due to the intervention of the Buyer or a repairer not approved by Srokashop. – defects and their consequences related to use not conforming to the purpose for which the product is intended (professional, collective use, etc.) – products subject to a specific assistance and maintenance contract. 14. LIABILITY
The products offered by Srokashop comply with current French legislation.
Srokashop cannot be held responsible for the non-performance of the contract in the event of stock shortage or product unavailability, force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communications.
Srokashop cannot be held responsible for any indirect damage that may arise from the purchase of products.
The total or partial impossibility of using the products, particularly due to hardware incompatibility, cannot engage Srokashop's liability or give rise to any compensation or reimbursement.
The Srokashop website also contains information from third parties, and links to other websites. Srokashop cannot under any circumstances be held responsible for damages resulting from the use, access to, or inability to use this third-party information, or the content of other websites.
15. PARTIAL INVALIDITY
If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law, regulation, or following a final decision of a competent court, the other stipulations shall retain their full force and scope.
16. NON-WAIVER
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions of sale shall not be interpreted in the future as a waiver of the obligation in question.
17. APPLICABLE LAW
Sales of Srokashop products are subject to French law.
18. DATA PROTECTION AND FREEDOM OF INFORMATION
The information collected by Srokashop during any Buyer's order is necessary for the management of their order by Srokashop and its commercial partners. In accordance with the French Data Protection Act n°78-17 of January 6, 1978, the Buyer has a right to access, rectify, object to, and delete data concerning them from Srokashop.
